General Provisions

Your personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR), and in accordance with the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781).

Data Collected Automatically

During your visit to the website opinieo.pl, the following data is automatically collected: your IP address, domain name, browser type, and operating system type. This data does not allow for the direct identification of your person.

The Administrator does not process personal data in an automated manner (including through profiling) in such a way that decisions could be made automatically or that could have legal consequences or otherwise significantly impact your rights and obligations.

If your data is subject to automated decision-making that results in legal effects or similarly significant impacts, such decisions will be made in accordance with the consent clause, which will be requested in a separate statement.

Purpose and Legal Basis for Processing Personal Data

1. Customers and Persons Designated for Contract Execution

When a contract is concluded with the Administrator or there is an intention to conclude such a contract, the data we process is necessary for the performance of that contract. This data was obtained directly from you.

Your personal data is processed for the following purposes:

  • to conclude and perform the contract (Article 6(1)(b) GDPR),
  • to fulfill the legal obligations imposed on the Administrator, particularly in terms of accounting (Article 6(1)(c) GDPR),
  • to pursue the Administrator’s legitimate interest, which includes providing service necessary for the conclusion and performance of the contract, responding to correspondence, maintaining business contacts, and establishing, defending, or pursuing claims (Article 6(1)(f) GDPR).

Providing personal data is voluntary but necessary to establish cooperation and fulfill the contract. Refusal to provide personal data will result in the inability to conclude and perform the contract or respond to your inquiry.

The personal data we process includes: name, surname, delivery address, email address, phone number, order details, and invoice data. For electronic transaction services, we also process login credentials, password, and purchase history.

Your data will be processed for the duration of the contract and stored as required by law, especially accounting laws. If applicable, it will also be stored until the expiration of claims arising from the contract, whichever period is longer.

 

2. Correspondents

When you contact the Administrator for purposes other than concluding a contract, the data we process includes your contact details and any information related to your inquiry. This data is obtained directly from you.

Your personal data is processed for the purpose of:

  • pursuing the legitimate interest of the Administrator, which involves responding to correspondence, handling inquiries, document circulation, and archiving (Article 6(1)(f) GDPR).

Providing personal data is voluntary but necessary to respond to your inquiry. Refusal to provide personal data will result in the inability to handle the correspondence, and the data will be immediately deleted.

We process the following categories of your data: name, surname, email address, phone number, and other information provided in your inquiry.

The data will be processed for periods specified by law or as long as its storage serves the legitimate purposes of the Administrator, particularly in terms of defending against claims. The retention period of correspondence depends on the purpose related to the inquiry.

 

3. Users and Visitors of the Online Store

When you create an account on the Administrator’s website to use electronic services, the data we process includes the information necessary to access these services. This data was obtained directly from you.

Your personal data is processed for the following purposes:

  • to ensure the functionality of the website and facilitate the use of the service (Article 6(1)(b) and (f) GDPR),
  • to perform contracts with the online store’s customers (providing services electronically) (Article 6(1)(b) GDPR),
  • to conduct billing, accounting, and financial reporting (Article 6(1)(c) and (f) GDPR),
  • to fulfill legal obligations (Article 6(1)(c) GDPR),
  • to pursue the Administrator’s legitimate interest in marketing its products and services (Article 6(1)(f) GDPR).

Providing personal data is voluntary but necessary to create an account on the service. Refusal to provide personal data will prevent the creation of an account and the use of the Administrator’s services in this regard.

We process the following categories of your data: name, surname, delivery address, email address, phone number, order details, invoice data, login, password, purchase history, and activity history.

Your personal data will be stored until consent is withdrawn or an objection is made, i.e., until you indicate in any way that you no longer wish to receive information about our services. After withdrawing consent or expressing an objection, personal data may be stored for the purpose of demonstrating compliance with legal obligations or until the expiration of claims, whichever is longer. If a contract is concluded with the Administrator (e.g., for electronic services or using the online store), personal data will be processed for the duration of the contract, and if justified, until the expiration of related claims.

Use of Data

Your personal data will be processed solely to the extent and for the purpose permitted by law or as covered by your consent.

Data collected automatically may be used to analyze user behaviour on the website or to collect demographic information about users.

Data collected during correspondence between you and the Administrator will be used solely to provide an accurate, complete, and timely response to your inquiry.

Data collected for the purpose of concluding or fulfilling a contract between you and the Administrator will be used solely to ensure proper and efficient handling of the contract.

Recipients of Data

Personal data will be shared with entities processing them on behalf of the Administrator (in particular: entities maintaining and providing IT systems, accounting and legal service providers) and collaborating individuals who must have access to the data to perform their duties.

We do not transfer your personal data to third parties or international organizations, i.e., outside the European Economic Area.

Data Storage and Deletion

The Administrator minimizes the storage period for personal data and processes it only for as long as necessary:

− for the duration of the contract and until the expiration of any limitation periods arising from applicable laws, such as tax obligations or civil law claims.

− to handle correspondence.

− until the withdrawal of previously given consent.

− until an objection is raised to the processing of personal data.

After the legally compliant period of data processing has passed, all personal data allowing for your identification will be deleted.

Your Rights

  1. Jeżeli Administrator przetwarza Państwa dane na podstawie dobrowolnej zgody, zgoda ta może zostać cofnięta w dowolnym momencie. Wyłączną konsekwencją cofnięcia zgody będzie fakt, że Administrator nie będzie mógł dłużej przetwarzać na tej podstawie Państwa danych osobowych. Cofnięcie zgody nie wpływa na legalność przetwarzania danych, które dokonało się przed tym cofnięciem.

  2. Przysługuje Państwu prawo dostępu do treści Państwa danych osobowych oraz ich poprawiania, sprostowania, usunięcia lub ograniczenia przetwarzania.

  3. Jeżeli znaleźli się Państwo w szczególnej sytuacji, która sprawia, że dalsze przetwarzanie przez nas Państwa danych zagraża Państwa prywatności, możecie Państwo zawiadomić nas o tym fakcie i wezwać do zaprzestania lub ograniczenia przetwarzania.

W przypadku, gdy podstawą przetwarzania danych osobowych jest prawnie uzasadniony interes – przysługuje Państwu prawo do wniesienia w dowolnym momencie sprzeciwu wobec przetwarzania danych osobowych z przyczyn związanych z Państwa szczególną sytuacją. W przypadku, gdy prawnie uzasadniony interes polega na prowadzeniu działań marketingu bezpośredniego – macie Państwo prawo w dowolnym momencie wnieść sprzeciw wobec przetwarzania dotyczących Państwa danych osobowych na potrzeby takiego marketingu, bez konieczności uzasadniania swojej decyzji,
